Sussex County Real Estate Market on the Rise

According to recent data released by the Sussex County Association of Realtors, single family home sales are on the rise in Sussex County, Delaware. The data released in late July 2014 suggests that, though the number of home sales in the county remained congruent with the same time period from 2013, the median home price rose by roughly 12 percent.

This trend is consistent with what we have been seeing all over the state of Delaware over the past 12 to 18 month period. Whether you are looking to buy or sell in the Wilmington area or even down state, be sure to have an experienced real estate attorney in your corner when you do so.

Weather Notice Regarding Delaware Courts

Due to inclement weather, the New Castle County Courthouse, Kent County Courthouse, Supreme Court, Family Court, and Court of Common Pleas statewide are closed. The Justice of the Peace Courts are closed with the exception of JP Court 2 which will be closing at 4 PM and the 24-hour Courts (3, 7, and 11) which will remain open. Sussex County Superior Court will close at 2 PM. Supreme Court oral arguments for 1/22 are postponed. Sussex County Superior Court will open at 9:30AM on 1/22. You can check back HERE for updates.

DUI Checkpoints Coming to Delaware this New Years Eve!

It’s Beginning to Look a Lot Like Personal Injuries

We love winter and Christmas and New Year’s and everything else about this time of the year. Make no mistake. We are not aiming to steal the fun out of the season by any stretch of the imagination.

However, we feel obligated to mention the loads and loads of personal injury cases out there that stem from accidents due to negligence in the winter months. Sure, it is okay to blame the weather. Ice and snow are a bear this time of year and we have all seen it firsthand in New Castle County and throughout Delaware over the past week. Two storms ranging from nuisance to standstill.

With this sort of weather comes the responsibility to safety. We are talking about the safety of yourself, family, employees, tenants and even folks you have never met.

When it comes to lawsuits and liability, we often have to consider who is negligent or at fault in a given situation. This applies to car accidents and unsalted sidewalks alike.

This winter, do yourself a favor. Slow down on the roads during snowy and icy conditions so as to avoid collision. make sure that sidewalks and other walkways are properly cleared, shoveled and salted so that clients, employees and pedestrians do not slip and fall on icy areas of your property.

This time of year should be one that is made of pure joy. Avoid the hassle that comes with lawsuits. Let us handle all of that. Enjoy your holiday season and be safe.

Our Well Wishes Go Out to Trooper Deskis

Yesterday, 17 year veteran Delaware State Trooper Richard Deskis was shot in the line of duty in Wilmington while on duty. As of this moment, the investigation and manhunt still continue so that those responsible can be brought to justice.

None of us can truly understand what the men and women of law enforcement go through (not to mention their loved ones) as it pertains to being shot in the line of duty. Some say that it is part of the job. Unfortunately, for these brave souls it is.

We hear that Trooper Deskis is out of the hospital and doing well and we hope he is well on his way back to recovering from his injury.

We would like to take this opportunity to thank all of the members of the Delaware State Police and all of those in law enforcement in the State of Delaware who sacrifice so much to keep us all safe everyday.

What NOT to do in case of a Car Accident

Every day we are out on the roads with thousands of other drivers –all of us trying to get to our jobs, schools and homes. And of course, every great once in a while the law of large numbers catches up with us and WHAM, we find ourselves in an accident on the roads. Here are a few quick tips for what not to do in case of an accident or fender bender.

1. Don’t Lose Your Cool – Even if you are not at fault (especially if you are not at fault), nothing good happens after you lose your cool. More likely than not, the police are going to show up on the scene and when they do, it is not in your best interest if you are screaming at another party involved in the accident. Remember, it is called an accident for a reason.

2. Don’t Fail to Document the Event – Immediately following an accident, you must do your best to advocate for yourself if possible. Assuming you are in the condition to do so, do your best to write down everything pertaining to the accident. In addition to the other driver’s name, contact info and insurance info, write down his or her vehicle’s make,model, color, VIN number, license plate number and even the number of passengers in the car and where they were sitting. You should take down the weather and road conditions at the time as well as the time of day. You will want to be well prepared for dealing with their insurance company, your insurance company and even the court system should it come to that.

3. Don’t Hesitate to Call the Police – Be wary of folks who are too eager to “take care of this without involving the police or insurance companies.” Often, those are the types of folks who no one ever hears from again. Not long after, you are the one stuck with repair and medical bills…and a slip of paper with a fake phone number on it, of course.

4. Do not Leave the Scene – We think it goes without saying. Leaving the scene of an accident is generally considered a major no-no in the State of Delaware and everywhere else in the US for that matter. If you want to turn a bad situation worse, leave the scene of an accident.

5. Fail to Recognize What’s Next – Accidents tend to have repercussions and consequences. There may be injuries even if it looks like everyone is okay at the scene. If there are injuries then you can bet there will be legal action. In short, don’t hesitate to follow up with your insurance company and you may well want to consult an attorney especially if another party is jumping to threaten a lawsuit.

Obviously, every accident or fender bender is different and some are clearly far far worse than others. However, at Giordano, DelCollo & Werb, we invite all of you to drive safely and follow these simple rules should you have the unfortunate luck to be involved in an accident.
